MTPA Code of Conduct

This Code of Conduct sets the standards of professionalism, integrity, and accountability expected from all members of the MOT Training Providers Association (MTPA). It applies to all member organisations, their employees, contractors, trainers, assessors, subject matter experts, directors, and representatives involved in MOT-related training, compliance, consulting, and associated services.

1. Purpose and Scope

The purpose of this Code is to ensure that every organisation operating under the MTPA banner contributes to a trusted, consistent, and ethical environment that supports the UK MOT Testing industry and maintains full alignment with DVSA requirements.

2. Professional Integrity

  • Act honestly and transparently in all business dealings, communications, and training activities.
  • Provide accurate, up-to-date information that reflects current DVSA requirements, legislation, and best practice.
  • Avoid misleading statements or misrepresentation of expertise, qualifications, or capabilities.
  • Maintain independence and impartiality, ensuring training materials are free from inappropriate bias or manipulation.

3. Compliance With DVSA Standards

  • Ensure all training content is aligned with the annual DVSA MOT tester curriculum.
  • Update training materials promptly following DVSA announcements, rule changes, or industry updates.
  • Base technical guidance on current legislation, DVSA guidance, and recognised industry best practice.
  • Notify the MTPA where significant compliance issues or potential risks to the industry are identified.

4. Quality of Training Delivery

  • Deliver training to high educational standards, ensuring clarity, accuracy, and learner-focused design.
  • Use qualified trainers and subject matter experts with a minimum of 5 years’ relevant industry experience or recognised equivalent.
  • Encourage continual professional development (CPD) for trainers, assessors, and authors.
  • Monitor and review learner feedback to improve courses and address issues in a timely manner.
  • Apply fair, consistent, and transparent assessment methods for all learners.

5. Ethical Business Practice

  • Operate legally, maintaining appropriate business registration, insurance, and compliance with relevant regulations.
  • Engage in fair competition, avoiding disparagement of other members or unprofessional commercial tactics.
  • Respect the intellectual property rights of other members and third parties, including content, branding, and proprietary tools.
  • Avoid conflicts of interest, or declare them clearly where they cannot be avoided.

6. Collaboration & Industry Contribution

  • Participate constructively in MTPA meetings, consultations, and knowledge-sharing activities.
  • Support the Association’s role as a structured channel between training providers and the DVSA.
  • Share relevant insights that help promote consistent national standards in MOT tester training.
  • Engage respectfully with other members, fostering a collaborative and supportive environment.

7. Confidentiality & Data Protection

  • Protect confidential information shared within the Association, including meeting minutes and draft materials.
  • Comply with UK GDPR and other relevant data protection laws when handling personal or sensitive data.
  • Refrain from sharing member-only or confidential information with non-members unless explicitly authorised.

8. Conduct of Representatives

Member organisations are responsible for the professional conduct of any person representing them in MTPA contexts (meetings, communications, events, and online spaces). Representatives must:

  • Demonstrate courtesy, professionalism, and respect in all interactions.
  • Avoid hostile, inappropriate, or disruptive behaviour.
  • Uphold the reputation of the MTPA as a professional, responsible body.

9. Responsibilities Toward Learners

  • Provide accurate, supportive, and professional guidance to all learners.
  • Treat all learners fairly and respectfully, without discrimination.
  • Ensure that learning environments (physical or online) are safe, professional, and appropriate.
  • Maintain a clear and accessible complaints process with timely responses.

10. Reporting Breaches & Accountability

  • Report significant breaches of this Code that may undermine the Association, learners, or the wider industry.
  • Cooperate with any MTPA review or investigation into alleged breaches.
  • Accept that the MTPA may apply proportionate sanctions, which may include:
    • Formal warnings
    • Corrective actions and improvement plans
    • Suspension of membership
    • Termination of membership and withdrawal of permission to use MTPA branding

11. Commitment to Continuous Improvement

  • Engage in continuous improvement to keep training and services relevant, effective, and compliant.
  • Remain open to constructive feedback from learners, peers, and the Association.
  • Support innovation in training methods, technologies, and delivery models that benefit the MOT Testing community.

12. Acceptance of the Code

By applying for and maintaining membership of the MTPA, each member declares that:

  • They have read and understood this Code of Conduct.
  • They agree to adhere to all requirements set out within it.
  • They understand that membership is dependent on ongoing compliance with this Code.
  • They accept that the MTPA may update this Code from time to time to reflect regulatory or industry changes.
